Terms of Service

These Terms of Service ("Terms") govern your access to and use of Lumina ("we," "us," or "our"), an AI-powered audience simulation platform operated at console.getlumina.in. By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Service Description

Lumina is a software-as-a-service (SaaS) platform that enables marketers and businesses to test their advertising content against AI-simulated audiences. Our platform generates synthetic personas using large language models to predict how defined audience segments might respond to your ads, campaigns, and marketing messages.

The simulations produce insights including predicted engagement metrics, audience sentiment analysis, and qualitative feedback. These results are computational predictions and should be used as one input among many in your marketing decision-making process.

2. Eligibility

You must be at least 18 years of age to use Lumina. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using Lumina on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration and Security

To access Lumina, you must create an account using a valid email address or by signing in through Google OAuth. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your login credentials
• Immediately notify us of any unauthorized access to your account
• Maintain only one account per individual — duplicate accounts may be suspended without notice
• Accept responsibility for all activity that occurs under your account

4. Subscription and Billing

Plans and Pricing

Lumina operates on a credit-based subscription model. We offer monthly and annual plans, with all pricing denominated in Indian Rupees (INR). Details of available plans and their pricing are displayed on our platform at the time of purchase.

Auto-Renewal

All subscriptions auto-renew at the end of each billing cycle unless cancelled before the renewal date. You will be charged the then-current rate for your plan. We will make reasonable efforts to notify you before any price increases take effect.

Payment Processing

All payments are processed securely through Razorpay. By subscribing, you authorize us to charge your selected payment method on a recurring basis. You are responsible for keeping your payment information current.

5. Free Trial

New users may be eligible for a 7-day free trial with limited simulation credits. At the end of the trial period, your account will automatically convert to a paid subscription at the plan you selected, unless you cancel before the trial ends. You will not be charged during the trial period. Each individual is entitled to only one free trial.

6. Simulation Credits

Your subscription includes a monthly allocation of simulation credits. Additional bonus credits may be earned by providing feedback on simulation results. Regarding credits:

• Credits are non-transferable between accounts
• Unused credits expire at the end of your billing period and do not roll over
• Bonus credits earned through feedback are subject to the same expiration rules
• Credits have no cash value and are not redeemable for money
• We reserve the right to modify credit allocations with 30 days prior notice

7. Acceptable Use

You agree not to use Lumina to:

• Simulate or test content that is illegal, hateful, sexually explicit, or that promotes violence or discrimination
• Reverse engineer, decompile, or disassemble any part of the platform or its underlying algorithms
• Use automated scripts, bots, or scrapers to access or extract data from the platform
• Attempt to circumvent rate limits, credit restrictions, or security measures
• Share your account credentials or provide access to unauthorized third parties
• Resell, sublicense, or redistribute simulation results as a standalone service
• Interfere with or disrupt the integrity or performance of the platform
• Use the platform for any purpose that violates applicable Indian law or international regulations

Violation of these terms may result in immediate suspension or termination of your account without refund.

8. Intellectual Property

Platform Ownership

Lumina, including its software, algorithms, user interface, design, documentation, and all related intellectual property, is and remains the exclusive property of Lumina and its licensors. Nothing in these Terms grants you any right, title, or interest in the platform beyond the limited right to use it as described herein.

Your Content

You retain ownership of all ad content, creative assets, and marketing materials you upload to or create on the platform. You also own the simulation results and insights generated from your content. By using our platform, you grant us a limited, non-exclusive license to process your content solely for the purpose of delivering the simulation service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMINA IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

In no event shall Lumina, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities arising out of or related to your use of the platform.

Our total aggregate liability to you for any claims arising from these Terms or your use of the platform shall not exceed the total amount you have paid to Lumina in the twelve (12) months immediately preceding the claim.

11. Termination

Either party may terminate this agreement at any time:

• You may cancel your subscription and delete your account at any time through your account settings or by contacting support
• We may suspend or terminate your account immediately if you violate these Terms, or with 30 days notice for any other reason

Upon termination, your right to access the platform ceases immediately. We will retain your data for 30 days following termination, after which it will be permanently deleted. You may request an export of your data during this 30-day window by contacting support@getlumina.in.

12. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be resolved as follows:

1. 1.Informal Resolution — The parties shall first attempt to resolve any dispute through good-faith negotiation within 30 days of written notice.
2. 2.Arbitration — If informal resolution fails, the dispute shall be referred to and finally resolved by arbitration under the Indian Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator mutually appointed by both parties, in Ranchi, Jharkhand, India. The language of arbitration shall be English.
3. 3.Jurisdiction — Subject to the arbitration clause above, the courts in Ranchi, Jharkhand, India shall have exclusive jurisdiction over any proceedings arising out of these Terms.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days advance notice via email and a prominent notice on the platform. Your continued use of Lumina after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the modifications, you must stop using the platform and cancel your subscription before the changes take effect.
